Waiver & Agreement
Two short docs you can read ahead of time. The host signs the rental contract during booking. Parents of attending kids sign the participant agreement at the event.
Host Rental Agreement
Every host needs to read and sign this agreement before the party. It covers acknowledgment of inherent risk, your responsibilities as the host, payment terms, our cancellation and weather policies, and liability protections for both parties. You sign it digitally during the booking flow — please read it in full before signing.
1. Acknowledgment & Agreement
By signing this agreement, the host acknowledges they have read and understand the full Daydream Bubble Parties LLC rental contract, agrees to abide by all of its terms and conditions, and has reviewed all setup and use instructions. The host warrants and guarantees they have the right and/or permission of the owner of the property to use the equipment being rented at the chosen event location. The host fully understands the potential for unanticipated risk associated with the use of all equipment provided by Daydream Bubble Parties LLC.
2. Host's Responsibility for a Safe Environment
The host agrees to provide a safe environment for the use of all rented items and equipment by ensuring continuous supervision by competent adults. The host agrees to take full responsibility to follow the rules of use, operation instructions, and setup requirements; to take all precautions to protect the equipment from damage and misuse; and to protect any anticipated user of any rented equipment or any person that may reasonably be in the immediate area of the equipment while in use.
3. Adult Supervision
An adult host must be present and supervising children throughout the entire party. Daydream Bubble Parties LLC is not responsible for injuries, lost children, or lost belongings of the client or their guests. Our professional operator runs the foam machine and assists with the flow of the event but does not act as a sole supervisor or babysitter. The operator may not carry out activities if there is no responsible adult present. If the host designates additional attendants, those attendants must (a) be sufficient in number for the equipment and attractions, (b) thoroughly understand proper operation and inherent hazards, (c) remain under direct supervision of the host, (d) command the presence necessary to maintain order, and (e) not be under the influence of any drugs or alcohol.
4. Acknowledgment of Risk
The host understands and acknowledges that the activity to be engaged in through the event — including foam party equipment, carnival-style games, and any other items provided — brings with it both known and unanticipated risks to the host, their guests, and their invitees. Those risks include, but are not limited to: falling, slipping, crashing, colliding, burning, cutting, and broken bones, and could result in injuries to eyes, nose, mouth, or limbs, illness, disease, emotional distress, death, and/or property damage to the host and/or their guests and invitees.
5. Concession Equipment Risks
If the booking includes the ice cream truck add-on or any other professional food concession equipment, the host acknowledges that such equipment may employ extremely hot or cold surfaces, scalding hot liquids, high-speed rotating cutters, fast-moving parts, high-voltage electricity, powerful mechanical drives, open flames, and other hazards. Improper use, proper use, or unforeseen mechanical failure may result in serious burns, cuts, loss of digits, loss of vision, broken bones, illness, disease, emotional distress, death, and/or property damage to the host and/or their guests and invitees.
6. Foam Safety
Daydream Bubble Parties LLC uses a professional foaming agent that is biodegradable, hypoallergenic, and non-toxic. It is safe for skin, eyes, hair, pets, grass, and the environment. It is not intended to be ingested — guests should not actively eat or drink the foam. Anyone with known chemical allergies should rinse off shortly after the party. Ingredient list is available upon request.
7. Foam, Mud & Clothing
Our foam is non-staining and washes out easily. There is the likelihood of mud and water getting onto clothing from playing in foam on wet grass. Guests should wear swimsuits, athletic clothes, or anything they don't mind getting wet, and bring a towel and a change of dry clothes. The foam, when mixed properly, is about as slippery as water. On wet grass it can be slippery — similar to a slip-and-slide or kiddie pool — so guests should be aware of normal slipping risk.
8. Pool & Water Safety
If the event is held near a pool, hot tub, or other body of water, the host is responsible for ensuring no minor enters the water without an adult present. Foam will not be allowed to enter the pool. Our operator monitors the play area and keeps foam coverage clear of pool edges so swimmers remain visible at all times.
9. Setup Requirements
The host is responsible for providing (a) a safe, level setup area, (b) an outdoor water source — we bring the hose, and (c) a sufficient grounded outdoor electrical outlet within 100 feet of the setup area — we bring the extension cord. The host confirms the setup area is free of hazards such as sharp objects, holes, glass, electrical wires, and similar conditions, and is appropriate for the expected number of guests. Some schools, churches, or daycares may require a key to unlock the water source — the host is responsible for arranging this. In the event of electrical failure or unavailable suitable power, Daydream Bubble Parties LLC will issue no refunds or credits.
10. Right to Refuse Delivery / Setup
Daydream Bubble Parties LLC retains the right at its discretion to not leave all or certain equipment at the host's premises due to space constraints, ground conditions, unsafe location or condition, inclement weather forecast, or any other reason which Daydream Bubble Parties LLC has the sole right to ascertain. If Daydream Bubble Parties LLC refuses delivery for any reason, Daydream Bubble Parties LLC will not be held liable for any damages. If no suitable location can be found for any equipment, the equipment will not be used and there will be no refund.
11. Weather Policy
Foam parties continue rain or shine. Light rain doesn't stop the fun — guests are getting wet anyway. Lightning, thunder, or severe weather will result in a temporary pause for safety. We may extend run time by up to 30 minutes to accommodate brief weather delays. If less than 45 minutes of foam time can be provided due to inclement weather, a 50% discount will be issued.
12. Cancellation Policy
Cancel at least 48 hours before the start time and your $100 deposit is fully refundable. Cancellations less than 2 hours before the start time qualify for a credit toward a future booking, available within one year of cancellation. Once the operator has arrived on-site, the deposit is non-refundable. Weather-related cancellations made before the operator travels to the event are always fully refundable. We do not refund deposits because the day turned out cold, windy, or otherwise uncomfortable — only for severe weather that prevents safe operation.
13. Deposit, Balance & Late Payment
A $100 deposit is required to hold a reservation. The remaining balance is due on the day of the event, paid via cash, card, or any major electronic payment method. Reservations are not finalized until the deposit is received. If the credit card on file is declined or a check is returned, the host will be informed and is responsible for immediately providing new payment information. There is a $30 returned check charge. Accounts not paid within terms are subject to a 5% late charge after a 10-day grace period and a 1.5% monthly finance charge thereafter.
14. Lateness
The Daydream Bubble Parties LLC operator makes every effort to arrive at events approximately one hour prior to the start time for setup. If our operator arrives more than 45 minutes late to the agreed start time, the host has the right to cancel the service and receive a full deposit refund. Once the host allows the event to begin, the host has agreed to pay as contracted, and the full contract amount is due.
15. Right to Refuse Service
Our operator's safety is essential. If our operator at any time feels that their safety has been compromised, has entered a volatile situation, or is abused physically, emotionally, verbally, and/or sexually harassed in any way, Daydream Bubble Parties LLC has the right to refuse service and instruct the operator to leave the premises immediately. In such cases, deposits are not refunded and the host may be charged in full.
16. Emergency Procedure
In the event of an accident, injury, or emergency, the host agrees to cease operations immediately and contact Daydream Bubble Parties LLC promptly after any necessary emergency action is taken (call/text 330-260-5888 or 234-301-2041).
17. Indemnification & Hold Harmless
The host agrees to hold harmless and indemnify Daydream Bubble Parties LLC and its owners, agents, and representatives for damages or injury to persons and property resulting from the use and rental of equipment provided pursuant to this agreement. In the event Daydream Bubble Parties LLC institutes suit in court in connection with any disputed matter relative to this contract, or in the event a suit is brought against Daydream Bubble Parties LLC arising out of the use and rental of any equipment, the host shall be liable for all reasonable attorney fees and costs Daydream Bubble Parties LLC may incur.
18. Insurance
The host agrees to maintain a policy of liability insurance (such as a homeowner's policy or event liability coverage) that by its nature will afford coverage for the ongoing activities and equipment provided by Daydream Bubble Parties LLC for any known or unanticipated injury or damage that may occur to any person or property. Although Daydream Bubble Parties LLC may carry its own general liability insurance, the host should in no way rely solely upon Daydream Bubble Parties LLC's insurance to provide coverage for any accident or injury. If a certificate of insurance is required by the event venue, please notify us at least one week in advance.
19. Equipment Condition & Damage Liability
Daydream Bubble Parties LLC does not guarantee any equipment to be free of cosmetic, manufacturer, or other defect that may affect the safety or operation of the equipment. The host acknowledges that in the event any rental equipment is damaged or destroyed during the rental period due to misuse, negligence, or failure to follow operating instructions, the host is liable for its repair or replacement cost.
20. Rule Violations Terminate Contract
The host agrees that if any provision of the user instructions or rules set forth herein by Daydream Bubble Parties LLC are not followed, the equipment rental shall be terminated immediately with no refund.
21. Property & Landscaping
The host acknowledges that landscaping, lawns, decorative outdoor fixtures, or other related items may experience footprints, mud, or minor wear from active play in foam on wet ground. The foam solution is organic and will not kill grass, but for events of 2 hours or more, we recommend setup on a paved area to limit mud and lawn wear. Daydream Bubble Parties LLC is not responsible for incidental landscaping wear caused by normal foam-party use.
22. Photography & Media
Daydream Bubble Parties LLC may take photos or videos during the event for use on the website, social media, and marketing materials. If you do not consent to the use of images that include identifiable minors, please notify us in writing before the event start time and we will exclude your event from media collection.
23. Entire Agreement
This agreement contains the entire understanding between Daydream Bubble Parties LLC and the host. It supersedes all prior and simultaneous agreements between the parties. These terms and conditions apply whether the host has read them in full or not. By hiring Daydream Bubble Parties LLC and signing below, the host accepts these terms. The only way to add or change this agreement is to do so in writing, signed by both parties.
24. Signature & Authority
By signing below, the host acknowledges they have read and understood this entire agreement, are at least 18 years of age, and have the authority to sign on behalf of the property owner and all participants and minors attending the event. The host's electronic signature, including the digital signature captured during the online booking flow, has the same legal effect as a physical handwritten signature under the federal ESIGN Act and the Ohio Uniform Electronic Transactions Act.
Parent / Guest Agreement (for individual participants)
Every parent or guardian of a participating minor agrees to the following before their child takes part in a foam party hosted by Daydream Bubble Parties LLC. The host is responsible for distributing this agreement to all attending parents and collecting signed copies before the foam party begins. Our operator will provide a bracelet to each participant whose signed agreement has been collected.
This is a legally binding Consent Form and Release of Liability made voluntarily by the undersigned, on behalf of themselves and on behalf of their heirs, executors, administrators, legal representatives, and assigns, to Daydream Bubble Parties LLC and its employees, members, officers, agents, and representatives.
The undersigned acknowledges that any activity involving the provided foam party equipment and active play involves inherent risk of physical injury. The undersigned assumes all such risks.
In consideration of Daydream Bubble Parties LLC allowing the undersigned (and any minor in their care) to participate in the foam party, the undersigned hereby releases and forever discharges Daydream Bubble Parties LLC, its owners, agents, employees, and representatives, from any and all claims, demands, rights, and causes of action of whatever kind or nature, arising from and by reason of any and all known and unknown, foreseen and unforeseen bodily and personal injuries, damage to property, and the consequences thereof, resulting from participation in or in any way connected with the foam party.
In the event of an emergency, the undersigned acknowledges that they are solely responsible for all medical and other costs arising out of bodily injury or any loss sustained through participation in this activity.
The undersigned personally assumes the inherent and other risks involved in foam party participation and agrees to hold Daydream Bubble Parties LLC, its members, managers, officers, employees, and agents harmless from any claim, including any claim made by the undersigned's family, estate, heirs, or assigns, which may result from use of the equipment or participation in any activity organized by Daydream Bubble Parties LLC.
By the execution of this agreement, the undersigned accepts and assumes full responsibility for any and all injuries, damages, and losses of any type which may occur to them, and to any participants (including any minor) which they will be supervising during the entirety of the event. The undersigned hereby fully and forever releases and discharges Daydream Bubble Parties LLC, its officers, employees, and insurers, from any and all claims, demands, damages, and rights of action, present and future, whether the same be known or unknown, anticipated or unanticipated.
The undersigned acknowledges that there is the likelihood of mud and water getting onto clothing, and that the foam play surface (wet grass or pavement) involves minor slipping risk similar to a slip-and-slide or kiddie pool.
The undersigned acknowledges that they have read and understood this agreement in its entirety and signs it voluntarily.
